Welfare Transportation Terms and Conditions of Carriage
(General Passenger Automobile Transportation Services – Partial Revision in Progress)

Article 1: Scope of Application

  1. Transportation contracts pertaining to the general passenger automobile transportation services operated by our company shall be governed by the provisions of these Terms and Conditions. Matters not stipulated herein shall be subject to applicable laws and regulations or general customs.
  2. If our company agrees to special arrangements that do not conflict with the intent of these Terms or relevant laws and regulations, such special arrangements shall prevail over the relevant provisions of these Terms.

Article 2: Instructions from Staff
Passengers must comply with instructions given by the driver or other company personnel when such instructions are necessary for the safe operation of the service.

Article 3: Acceptance of Carriage
Except as otherwise provided in Article 4 or Article 4-2(2), our company shall accept transportation requests from passengers.

Article 4: Refusal of Carriage or Continuation of Service
We may refuse to accept or continue carriage if any of the following conditions apply:

  1. The request does not conform to these Terms.
  2. Our vehicles are not suitable for the requested transport.
  3. The requester demands special burdens in relation to the transport.
  4. The transport would violate laws, public order, or morality.
  5. Transport is hindered by natural disasters or unavoidable circumstances.
  6. The passenger refuses to follow measures required by the Passenger Car Transportation Business Regulations.
  7. The passenger possesses prohibited items such as knives, in accordance with the above Regulations.
  8. The passenger carries items that have been previously refused under Article 4-3(3) or (4).
  9. The passenger is intoxicated to the extent that they cannot clearly state their destination or walk unaided.
  10. The passenger’s attire is so unclean that it may contaminate the vehicle.
  11. The passenger is seriously ill and unaccompanied.
  12. The passenger is diagnosed or suspected of having a Category I or II infectious disease, a new strain of influenza, or another designated or newly identified infectious disease requiring hospitalization under relevant health laws.
  13. In cases (9)–(12), transport may be provided only using our designated vehicles, subject to advance notice from the passenger. We may adjust the vehicle or service content based on the situation.

Article 4-2: Non-Smoking Vehicles

  1. Passengers must refrain from smoking inside designated non-smoking vehicles (clearly labeled as such).
  2. If a passenger smokes or attempts to smoke inside a non-smoking vehicle, the driver may instruct them to stop. Failure to comply may result in refusal or discontinuation of carriage.
  3. If a passenger smokes inside a non-smoking vehicle, the company may seek compensation for cleaning costs (including for the driver’s clothing) and for any business interruption caused during the cleaning period, in addition to the applicable fare.

Article 4-3: Restrictions on Carry-On Items

  1. Passengers may not bring into the vehicle items listed under Article 4(7).
  2. If we have reason to believe prohibited items may be concealed among the passenger’s belongings, we may ask for the contents to be disclosed.
  3. If the passenger refuses this request, we may deny the carriage of such items.
  4. Even if disclosure is made, if the contents resemble prohibited items and are difficult to distinguish from them, we may deny carriage unless the passenger provides reasonable proof that the items are not prohibited.

Article 4-4: Customer Harassment

  1. Passengers must refrain from engaging in customer harassment toward the driver (including sexual, moral, or any conduct that causes discomfort, threatens dignity, disadvantages, or intimidates the driver).
  2. If harassment occurs, the driver may ask the passenger to stop, and the company may refuse or discontinue carriage.
  3. In such cases, we may seek compensation for all resulting damages, including emotional distress suffered by the driver.

Article 5: Fares and Charges
The fares and charges collected by our company are based on rates approved or reported to the relevant District Transport Bureau as of the time of boarding.

Article 6: Collection of Fares
Passengers must pay the fare and applicable charges at the time of disembarkation.

Article 7: Liability to Passengers

  1. If a passenger’s life or body is harmed due to the operation of our vehicle, we shall be liable for any resulting damages. However, this does not apply if we can prove that:
    • Our company and staff were not negligent in operating the vehicle,
    • A third party (other than our staff or the passenger) was at fault, and
    • There were no structural or functional defects in the vehicle.
  2. Our liability begins when the passenger boards the vehicle and ends when they disembark.

Article 8: Other Liability
We shall also be liable for damages caused to passengers in connection with transportation services, unless we can prove that our company and its staff were not negligent.

Article 9: Exemption from Liability
We are not liable for any damage caused to passengers if transportation is suspended or disrupted due to natural disasters or other unavoidable events beyond our control.

Article 10: Passenger Responsibility
If our company suffers damages due to the intentional or negligent actions of a passenger, or due to their violation of laws or these Terms, we may seek full compensation from that passenger.
